NEW DELHI: The Delhi high court on Tuesday asked the new government at the Centre to clarify its stand on the implementation of the amended Delhi Rent Act, 1995.

A division bench of Justice Badar Durrez Ahmed and Justice Siddharth Mridul directed the Centre to place its stand on the politically sensitive issue. Successive governments have shied away from giving effect to the act for almost two decades.

The previous government had begun moves to repeal the 1995 act, even as the amended act came as a ray of hope for property owners in Delhi, who have been receiving pittance as rent due to the ceiling fixed by the original act in 1958.

During the hearing of a petition challenging the constitutional validity of the 1958 Rent Control Act, the bench directed additional solicitor general Sanjay Jain to report to court the thinking of the central government on the issue before the final arguments are heard in the case on October 16, 2014?the next date of hearing.

HC is hearing a petition filed by an association of landlords, led by advocate Shobha Aggarwal, who highlighted before the court that the previous government had introduced a bill in Rajya Sabha in August, 2013, to repeal the Delhi Rent Act, 1995.

While the petitioners urged the court to direct the government to notify the 1995 Act, the high court deemed it fit to seek the government's view on the matter.

Aggarwal alleged that it is only because of vote bank politics that successive central governments have failed to implement the Delhi Rent Act, which received the assent of the President on 23 August, 1995.
