BHUBANESWAR: The Bhubaneswar Development Authority (BDA) on Monday began demolishing an 'unauthorized' four-storey guesthouse near Jayadev Vihar here. The structure came up in 2011 in alleged violation of building norms.

In 2007, the BDA had approved plan for a two-storey house on 2,352 square feet land for residential purpose. But the owner of the plot and lodging, Jayanti Sahoo, illegally constructed a four-storey building on it for commercial purpose, official sources said.

On March 2, 2009, the BDA registered a case against the owner for violations under the Odisha Development Authority (ODA) Act. Though the demolition order against the structure was issued on July 8, 2010, it could not be executed due to legal hurdles, a BDA officer said.

"The entire structure is illegal as BDA had approved plan for a two-storey residential building. We had been planning to demolish the building since long, but for legal problems and absence of police force," said BDA's enforcement officer Deba Prasad Dash. This was fourth major demolition of unauthorized high-rises in the city in past four months.

BDA authorities said the "violator" did not even apply to regularize the deviation under "amnesty scheme", which was in vogue in 2009. Under the system, violators paid fines for minor deviations in construction.

The lodging's leaseholder Ramachandra Sahoo, who is the husband of the owner, admitted his wife was granted permission to construct a house for residential purpose. "The entire building is not unauthorized. Only the third floor has been built illegally," Sahoo told TOI.

Soon after receiving the notice a few days ago, Sahoo moved the Orissa high court, seeking a stay on the demolition. "My case has not come up for hearing in the high court. I am now planning to file a case against the BDA for declaring my entire building as unauthorized," Sahoo added.
