Estate department has long list of illegal occupants

LUCKNOW: Former prime minister Chandrashekhar passed away in July, 2007, but two type-V housing units in Lucknow's posh La Place Colony remain in his possession. Documents available with TOI through RTI filed by Mahendra Shukla show that housing units 301 and 302, both type-V, are still in possession of allottee Chandrashekhar, former prime minister. The RTI document signed by Umakant Mishra, under secretary and public information officer further mentions that action is being taken under Act-12 of the State Estate Department, 2010.

Another case in point is of BJP Member of Parliament from Lucknow, Lalji Tandon, who has been staying in Darul Shafa bungalow (house number 9) without any allotment, while the allotment of Dayaram Prajapati, Member of Legislative Council (house number 7) has been cancelled by the department, and a petition has been filed in the high court. Zafar Ahmed Farooqui, chairman of the Sunni Central Waqf Board, who enjoys the status of minister of state, occupies 30 Ty-6 bungalow (type 6), despite being transferred on March 1.

Apart from this, members of UP legislative assembly Rajesh Agarwal (BJP MLA from Bareilly Cantonment), Shahid Manzoor (SP MLA from Kithore), Rajesh Yadav (SP MLA from Katra) and Dharampal Singh (BSP MLA from Etmadpur) are unauthorised occupants of their current place of residence. Rajesh Agarwal is staying without allotment at 53, Gulistan Colony (type-5), while Shahid Manzoor, Rajesh Yadav and Dharampal Singh are staying without allotment at house numbers 101, 202 and 602 La Place Colony, respectively.

Interestingly, the office of the Akhil Bharatiya Loktantrik Congress, which was started by Rajya Sabha member Naresh Agarwal of Samajwadi Party, whose allotment was cancelled on December 21, 2012 continues to operate from the precincts of 4, Forsyth Road, a type-VI bungalow. Senior administrative officer, civil aviation Nuzhat Ali's allotment of house number ED-25, Diamond Dairy was cancelled on November 19, 2010, but the officer is still in possession of the house.

House number 21, Gulistan Colony is still in the unauthorised possession of Dr Hariom, the district magistrate of Moradabad, who was transferred on April 13, 2012. Similarly, Dr GK Goswami (IPS) who has been transferred to the Centre on January 16, 2012, was allowed to stay in A-6 Dilkusha Colony (type-IV) till March 31, 2012, but he continues to possess the said housing unit. Syed Wasim Ahmed, superintendent of police Barabanki, who was transferred on March 30, 2012, is still an occupant of 49, Gulistan Colony (type-V).

Not to be left behind in the race to grab government housing units are government advocates. RTI documents reveal that despite their posts ceasing to exist on May 24, 2012, as many as six government advocates have unauthorised possession of government houses. These include Dilip Kumar Gautam (MIG-95 Aliganj Colony), Tej Singh (MG-7, Aliganj Colony), Subhash Chandra Mishra (MIG-68, Aliganj Colony), Jagan Prasad Garg (C-10 Nirala Nagar and hearing in the case is going on), Manish Kumar Singh (C-5 Nirala Nagar), and RP Shukla (C-18 Nirala Nagar). Retired officer of the higher judicial services ZU Khan too has come under the scanner.

Action is being taken under Act-12 of the State Estate Department, 2010 against former MLA Kamlesh Pathak, who is having unauthorised possession of house number 12/3 Dalibagh since May 13, 2007.

According to the RTI document, the list of defaulters who are in authorised possession of types-IV, V and VI government housing units includes Rajiv Malhotra (additional superintendent of police, Khiri), Satya Prakash Nayak (additional judge Barabanki), Ajay Kumar Singh (chairman Allahabad Development Authority), Dr AK Sharma (IAS and commissioner of Devipatan division), Shyam Singh Yadav (vice-chairman Muzaffaranagar Development Authority) and RN Singh Yadav of Allahabad, retired IAS officer BB Singh. All these persons are currently residing in Butler Palace.

The case of Piyush Srivastava (Deputy SP of Sadar, Unnao), who is the occupant of C-4 Nirala Nagar is also under consideration. Additional district magistrate of Budaun Sanjay Kumar Singh (occupant of 4 Typ-5 Raj Bhawan Colony), medical officer, ayurveda DR VK Mishra (4/9 Dalibagh Colony), late Suryakant Dikshit (6/4 Dalibagh Colony), Rajan Lal Srivastava (tehsildar of Sadar, Gonda), Vinod Kumar Singh, who is the assistant engineer, panchayat, Bareilly (D-215, Gomtinagar) and Dr Sandeep Shukla, who is the child development project officer, Sultanpur (A-1401 OCR Colony) are also the part of the dubious list.

Among the offices, which still have the unauthorised possession of the government housing units are Ekikrit Vikas Sansthan (ED-16 Talkatora) and Pushpanjali Sansthan (B-103, Lalbagh Colony). Action against Ekikrit Vikas Sansthan is being taken under Act-12 of State Estate Department, 2010. Apart from this, there are as many as 13 journalists (including four deceased) who are still in unauthorised possession of the government housing units.

The break-up of defaulters' list is: Butler Place(8), Kaiserbagh(3), Niralanagar (4), Raj Bhawan Colony (5), Dalibagh Colony (7), Talkatora (2), Aliganj Colony (4), Gulistan Colony (3), La Place Colony (5), Lalbagh Colony (1), Dilkusha Colony (1), Gomtinagar Colony (2), OCR Colony (1), Diamond Dairy Colony (1), Bungalows of Darul Shafa (2), Mahanagar Colony Middle Income Group (4), DM Compound (1) and Forsyth Road Darul Shafa (1). Nearly 12 unauthorised occupants include junior level administration officials living in various colonies of the State Estate department have also come into light in the RTI documents.
