BDA bid to stop sale of land in parts

BHUBANESWAR: The Bhubaneswar Development Authority (BDA) has decided to seek an amendment to building regulations from the government to reintroduce a provision that prevents sale of part of a plot in the city without BDA approval.

The BDA believes dividing up plots and selling them off in a haphazard manner deters planned growth of the city.

Though such a condition existed in the original Orissa Development Authorities (ODA) Act 1982, the state government had deleted it (Section 116 of the Act) in 1985. A BDA meeting chaired by housing and urban development minister and BDA chairman Pushpendra Singhdeo on Tuesday decided that it would ask the government to amend the Act to bring back the provision.

Land owners are dividing their plots in to small fractions and selling them to different people in a haphazard manner, because of which houses are coming up without roads or drains leading to unplanned growth, a BDA officer said.

Section 116 says no registration of part of a plot would be made by revenue authorities without clearance from the development authority concerned. Though it was a strong deterrent to curb unplanned division of land, the government deleted the condition saying that it delayed the land registration process. The deletion has given rise to several unauthorized buildings coming up, thus defeating the concept of a planned city, the officer said.

BDA has decided that it will request the revenue department not to allow registration and mutation of part of a land plot without its approval. The revenue department would also be asked to seek views of the BDA before allowing land use changes to ensure that land is used in accordance with the comprehensive development plan.

BDA will also undertake awareness drives to dissuade the public from dividing and selling plots, to alert them not to buy parts of a plot with unauthorized layouts as BDA would not approve building plans on such plots.

Developers registered with BDA have to submit an affidavit stating that they will not indulge in selling plots with unauthorized layouts. If they deviate from the rules, the BDA will blacklist them, the BDA officer said. Real estate developers have welcomed the BDA decision. "It is a good decision needed to ensure planned growth. It will help check dubious practices of selling land without roads, which is a major concern in several areas of the state capital," said Association for Odisha Real Estate Developers president Umesh Patnaik.
