Buyers cry foul as promoter plots close to HT lines unusable

GURGAON: Buyers of plots at Vatika India Next project in Sector 83 alleged the developer is promoting the project on the basis of an outdated layout plan.

Three years ago, Noida resident Kavita (name changed) invested in two plots at Vatika. When she visited the plots last month, she found an overhead high tension (HT) line passing over them. "I've been asking the developer to show plot demarcations. When they finally did last month, I found HT lines over both. You can't build within 15m on either side of an HT line. I've already paid Rs 80 lakh for one plot and Rs 38 lakh for another," she said. "The minimum gap prescribed by Indian Electricity Rules, 1965, between a building and an HT line is 15 m," said Sanjeev Chopra, general manager of DHBVN (Dakshin Haryana Bijli Vitran Nigam), admitting Kavita's concern as genuine.

Kavita is not alone. There are others who invested in plots in streets J-10 and J-11 of the project who face the same hurdle. Rakesh, a buyer, alleged, "The developer knew there are four HT lines in the area. They neither showed us those in the layout, nor in the BBA (builder buyer agreement). Now the developer is threatening us an 18% penalty for delay in payment of installments."

District Town and Country Planning (DTCP) clearly states that if a layout plan is changed after plots are sold, the developer has to inform all plot holders about the revised plan through a public notice, which has not been done.

Vikas Yadav, a resident of Harsru village, said, "There are four HT lines in the area. When the developer applied for license four years ago, there were only three. But by the time the license and layout were approved, another HT line of 400 KVA was laid. Yet, the developer didn't even get the license revised."

Yadav came to know of the issue when the developer approached him to sell his plot in lieu of other plots in the project. "The developer hasn't got the revised plan approved. It's still selling plots on the basis of the old layout plan, which shows only three HT lines. Meanwhile, the layout is bound to change again," said Yadav.

An official spokesperson for Vatika said, "We have an approved layout plan for our Sector 83 project. Streets J-10 and J-11 are part of it. Moreover, the overhead HT lines are defunct and HUDA is in the process of replacing them with underground HT cables." The company, however, refused to share any new layout plan.
