Flat owners refuse to pay extra compensation, say will move HC

GREATER NOIDA: The Greater Noida Authority has issued notices to 32 housing societies, asking them to pay Rs 2,015 per square metre as additional compensation for land-losers.

Officials in the Authority said the notices had been served according to the orders of the Allahabad high court, which had in 2011 directed 64.7% additional compensation to farmers whose land was acquired in Greater Noida.

But residents of these societies have refused to pay up. On Sunday, people living in 28 of these 32 housing societies gathered formed a common front and named it Greater Noida Awas Sangharsh Samiti to protest against the demand for additional compensation.

"These 28 societies, including Vidhi Vihar, Gail, NSL, Jyoti Kiran, BSNL officers' housing, NSG, Anandam, NTPC housing, Delhi Police housing and several others are developed on land of 38 villages. Additional compensation will put a burden Rs 5 lakh-10 lakh on each flat owner," said Raj Kumar Nagar, secretary of Vidhi Vihar. "The Authority, in the notice, has asked to pay the money in four instalments. The first instalment is due on February 15 but residents have refused to pay and plan to move the high court for relief," he added.

In the October 2011 order, the court had directed all three authorities, Noida, Greater Noida and Yamuna expressway, to pay additional compensation to farmers. Noida and Greater Noida have already decided to collect additional solatium from allottees.

In Greater Noida, owners of residential land have been asked to pay an additional Rs 1,465 per sq m. Owners of group housing flats have to cough up Rs 2,015 per sq m while plot owners with other categories of land use like institutional, industrial and recreational need to pay Rs 550 per sq m. Commercial land allottees are being charged an extra Rs 3,300 per sq m.

"It is unfair to make homeowners pay for extra compensation. If there was a flaw in the original acquisition, the Greater Noida Authority is responsible, not those who subsequently bought houses built on the acquired land. It is the Authority, therefore, that must bear the extra cost now," Nagar said.

A senior official in the Greater Noida Authority said, "The Authority is just following the lease deed conditions on which plots were allotted to these societies. We do not want to put any burden on home-owners but the Greater Noida Authority is also reeling under a financial burden and needs the money to pay farmers."
