BHUBANESWAR: The state government on Tuesday asked land registering officers not to reject registration of properties on flimsy grounds, amid continued deadlock over land transaction for past eight months.
In a clarification on Orissa high hourt verdict in October in a case challenging the mandatory government norm of producing record of rights (ROR), called patta, by seller of the land during registration, revenue secretary Taradatt on Tuesday said if the seller doesn't have the ROR, he has to produce documents establishing flow of land tile to him by producing ROR of previous owners. "The registering officer should carefully examine the documents and avoid rejecting them under flimsy grounds," he wrote to the inspector general of registration and district collectors.
Taradatt asked tehsildars to initiate mutation, the government procedure to create ROR, within 24 hours of receiving an application and update land records within 90 days. Penalty proceedings would be initiated against defaulting officers, he wrote.
In case of death of a person, owning a property, RORs would be updated in the name of legal heirs. He asked the district collectors and sub-collectors to hold monthly meetings to dispose of pending cases.
Land transactions had significantly reduced after the state government issued an order on April 25 that 'the registering officer shall not register any document presented to him unless the transferor produces the ROR to his satisfaction that such transferor has right, title and interest over the property so transferred'. After the order, the officers insisted on updated pattas.
Lawyer Dhabala Prasad Pradhan had moved the HC alleging that the order was misinterpreted by the registering authority. Confusion prevailed as the registering authorities were not sure if it applies to all registrations in general or Pradhan's case in particular.
