BENGALURU: The Karnataka high court on Saturday ordered notice to the BDA and BBMP over a PIL challenging the allotment of land reserved for a park in the city. The plot of contention is a 31,600 sqft civic amenity site that was sold to the son of a former BDA chairman for just over Rs 1 lakh. The PIL contended that the site was then resold the same day to a Kerala-based realty firm for Rs 18 crore.
The PIL was filed by residents of SBI colony, Koramangala 1st A Block, where the park was to come up.
A division bench headed by Justice Subhro Kamal Mukherjee also ordered notice to B Sreedhar Murthy, son of former BDA chairman C Basavaiah, and Kayaltheeram Builders and Realtors India Private Ltd, a Kochi-based company.
The PIL was filed by Ranjal Raghuram Shenoy and 11 other local residents seeking quashing of the said allotment and sale deed and agreement executed by the BDA.
The petitioners claimed that the civic amenity site was shown as reserved for park and open space in the Comprehensive Development Plan of 1995. They contended that in violation of norms, the BDA allotted the site to Murthy in 1985 and a sale deed was executed in his favour on August 1, 2014 for Rs 1,25,547. On the same day, it was sold to the Kochi builders by Murthy for Rs 18 crore.
The petitioners prayed that the land be reinstated for the purpose for which it was originally reserved in the CDP.
