MUMBAI: Bringing the Maharashtra Housing and Area Development Authority (Mhada) under the ambit of the Consumer Protection Act, a consumer forum recently reprimanded the authority for providing substandard homes after a buyer complained about leakages.
"We are of the view that the substandard construction of these flats and negligence on the part of opponent to take prompt action on the correspondence of the complainant shows their attitude towards lower income group persons and flats allotted to them," the forum said.
The forum refuted the Mhada argument that the complaint was not maintainable as Section 173 of the Mhada Act prohibits filing of a suit without notice to Mhada.
"The complainant has filed a complaint under the Consumer Protection Act, which cannot be equated with a suit," the forum said.
The Konkan Mhada has been directed to pay the complainant, Vinayak Kadam, Rs 50,000 for deficiency in service and unfair trade practice.
