PUNE: The Pune Municipal Corporation (PMC) has scrapped the imposition of a fine on flat owners residing in apartments without a completion certificate. Residents living in flats without the document had to pay three times the property tax as penalty.

The standing committee approved the proposal though the decision will be applicable only for residential apartments that have come up between 2005 and 2012. However, citizens must ask the builders or developers for the completion certificate before taking possession of the flat, the civic body has said.

Neither are the builders nor are the occupants particular about the completion and occupancy certificates, the civic body observed. The law mandates that a title to the property is perfected only after the completion certificate is received.

During the construction of a building, the developer has to seek no-objection certificates from various civic departments, including water supply and electricity connection. The NoC states that the building construction is according to the sanctioned plan and there is no violation of norms.

After the project is completed, civic authorities inspect the premises and issue a completion certificate if the construction is as per the sanctioned plan approved by the civic body. In the next step, the builder has to apply to the civic departments with a copy of the completion certificate to get water, electricity and other basic amenities for the project.

A completion certificate is denied to a builder if he fails to adhere to the PMC norms, does not provide amenities or undertakes construction not in accordance with the approved plan.

Many builders and developers sell flats without the completion certificate. Although the completion certificate is denied to penalise the builder or the developer for not fulfilling the norms, it affects the flat owners who cannot resell or mortgage the property without the document.

In 2005, the civic body had decided to allow flat owners to approach it for the document, but the scheme was scrapped.

The civic body's announcement that it would approach the state government for an amendment to the development control rules enabling the civic body to act against builders who sell property without the completion certificate has made little progress, so far.
