Pay Rs 20K or face 3 year jail: Forum to real estate firm bosses

CHANDIGARH: The District Consumer Disputes Redressal Forum has fined managing director Udey Raj Singh Brar and director Amarjit Singh of real estate firm UK Homes with Rs 10,000 each, holding them guilty of non-compliance of orders to refund more than Rs 4.50 lakh to a complainant. They would face imprisonment of three years if they failed to comply with the orders, the forum ordered.

It had earlier issued bailable warrants against the two to make them appear in the court but that too was not executed.

In its recent order, the forum stated even after applying coercive method to procure the presence of the builders and issuing bailable warrants, which were returned unexecuted, indicates that they are willfully evading the compliance of the order of this forum. This act of the builders "can be termed as a willful disobedience of the orders of this forum" and we declare the builders "guilty of non-compliance of the order dated November 27, 2014 Forum. Therefore, the builders "deserve to be adequately punished".

The previous order case was to be complied within 45 days. However, the builders did not repay the amount nor did they appear in front of the forum after the complainant for non-compliance of the order was filed by Vineet Talwar, the complainant.

The forum had directed the builders to "refund the total amount of Rs 4,19,250 paid by the complainant along with interest at the rate 12% per annum from the respective dates of deposit till realization, to pay Rs 50,000 as compensation for mental agony and harassment caused to the complainant and to pay Rs 7,000 as costs of litigation."

The order had further stated that this order be complied with within 45 days from the date of receipt of its certified copy, failing which the refund and compensation shall carry interest @18% per annum from the date of this order till actual payment besides payment of litigation costs.

The recent order has to be complied by the builders within 30 days on the receipt of the certified copies of this order, by intimating the office of this forum with valid proof of its payment within the stipulated period, failing which the accused, Brar and Amarjit, would be liable for a simple imprisonment for three years each, along with the payment of the fine.
